Terms of Service

1. ACCEPTANCE OF TERMS

By accessing or using FLORA (the “Service”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree to these Terms, do not use the Service. These Terms constitute a legally binding agreement between you and Fhloston Digital (“we,” “us,” or “our”). Your continued use of the Service following any updates to these Terms constitutes acceptance of the revised Terms.

2. DESCRIPTION OF SERVICE

FLORA is an AI-powered wellness tool that interprets direct-to-consumer (DTC) gut health test results. You upload your test PDF; we extract the text, pass it to an AI model (Anthropic Claude), and return a structured intelligence report that includes a biomarker analysis, personalized meal plan, supplement guide, and 30-day action plan.

The Service is provided for educational and informational purposes only. It is not a medical device, diagnostic tool, or substitute for professional medical advice, diagnosis, or treatment.

3. ELIGIBILITY

The Service is intended for individuals who are 18 years of age or older and residents of the United States. By using the Service, you represent and warrant that you meet these eligibility requirements. We reserve the right to restrict access to other jurisdictions at any time.

4. PAYMENT TERMS

Access to the Service requires a one-time payment of $47 USD, charged at the time of report generation. All payments are processed securely by Stripe. We do not collect or store your payment card details.

Refund Policy: Due to the computational cost of AI processing, all sales are final once your report has been successfully generated and made available for download. If the report fails to generate due to a technical error on our end, you are entitled to a full refund. Refund requests for failed reports must be submitted to hello@floralytic.com within 7 days of the attempted purchase.

5. HEALTH DISCLAIMER

FLORA IS NOT A MEDICAL SERVICE. Nothing in your report constitutes medical advice, diagnosis, treatment, or a doctor-patient relationship. The information provided is for general educational and wellness purposes only.

Always consult a qualified healthcare provider before making changes to your diet, supplement regimen, or health routine — especially if you have a pre-existing medical condition or are taking prescription medications. Do not disregard professional medical advice or delay seeking it based on anything provided by this Service.

6. USER RESPONSIBILITIES

You agree to:

• Upload only test data that belongs to you personally.
• Use the Service in good faith and only for its intended purpose.
• Not upload test data belonging to minors, other individuals, or third parties without their explicit consent.
• Provide accurate information when required (e.g., during payment).
• Comply with all applicable laws and regulations in your use of the Service.

7. INTELLECTUAL PROPERTY

All software, design, code, branding, and underlying systems of the FLORA platform are owned by Fhloston Digital and protected by applicable intellectual property laws.

Your health data remains yours. You retain all rights to any test data you upload. The generated report output is yours to use for personal, non-commercial purposes. We do not claim ownership over your health information or your report content.

8. AI-GENERATED CONTENT DISCLAIMER

Your report is generated by an artificial intelligence model (Anthropic Claude). While we design prompts and workflows to maximize accuracy and utility, AI-generated content may contain errors, omissions, or outdated information. The output is not reviewed by a licensed medical professional.

You acknowledge that you assume full responsibility for any decisions or actions you take based on your report. Fhloston Digital expressly disclaims liability for any harm arising from reliance on AI-generated content without independent professional verification.

9. PROHIBITED USES

You may not:

• Reverse engineer, decompile, or attempt to extract source code from the Service.
• Use the Service to process test data in bulk for commercial resale or redistribution.
• Attempt to circumvent payment systems or access reports without payment.
• Engage in any fraudulent, abusive, or unlawful use of the Service.
• Upload content that is illegal, harmful, or violates the rights of others.
• Use automated scripts or bots to interact with the Service.

10. LIMITATION OF LIABILITY

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, FHLOSTON DIGITAL AND ITS OFFICERS, EMPLOYEES, AGENTS, AND LICENSORS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE.

IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS EXCEED THE AMOUNT YOU PAID FOR THE SERVICE ($47 USD). SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF CERTAIN DAMAGES, SO THESE LIMITATIONS MAY NOT APPLY TO YOU.

11. TERMINATION

We reserve the right to suspend or terminate your access to the Service at any time, with or without notice, if we reasonably believe you have violated these Terms or engaged in fraudulent, abusive, or unlawful conduct. Termination does not entitle you to a refund except where your report failed to generate as described in Section 4.

12. GOVERNING LAW

These Terms are governed by and construed in accordance with the laws of the State of California, United States, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the state and federal courts located in California.

13. CHANGES TO TERMS

We may update these Terms from time to time. When we do, we will revise the “Last Updated” date at the top of this page. Your continued use of the Service after any changes constitutes your acceptance of the updated Terms. We encourage you to review these Terms periodically.
